Terms of service

1. Agreement

AUX ("we," "our," or "us") is a free-to-play stock market game for music. These Terms of Service ("Terms") govern your use of the AUX app for iPhone, available on the App Store, and the game service behind it ("AUX"). By creating an account or using AUX you agree to these Terms and to the AUX Privacy Policy. If you do not agree, do not use AUX.

2. Eligibility and accounts

• You must be at least 18 years old, or the age of majority where you live if that is higher.
• One account per person. You are responsible for activity on your account and for keeping access to your email or sign-in provider secure.
• Your username must not impersonate anyone or infringe anyone's rights. We may reclaim or change usernames that do.

3. Your portfolio, scores and game items

In AUX you pick albums for your portfolio and may swap them. Your results are shown only as percentages: how much your portfolio has moved, and your place on the leaderboards and in leagues. AUX has no money of any kind: no cash, no coins, no balance and no dollar amounts. Your portfolio, scores, ranks and league results are the game's virtual items.

• Game items have no cash value. They cannot be purchased with real money, and they cannot be sold, transferred, traded between players, exchanged or redeemed for money, goods, services or anything else of value, inside or outside AUX.
• You do not own game items. We grant you a limited, revocable, non-transferable license to use them within the game.
• We may adjust, recalculate, reset or remove portfolios, scores and ranks, for example to correct errors, reverse abuse, or change the game. Because no money is paid for them, no refunds or compensation apply.
• Game items are forfeited when your account is deleted or terminated.
• Selling or buying AUX accounts or game items outside the game is not allowed.

4. A simulated market, not an investment

AUX lets you build a simulated portfolio of albums. Words such as "market," "stock," "price," "swap," "portfolio," "pre-order," "move," "up," "down" and "gain" describe game mechanics. An album's price is its average daily streams over the past 7 days, calculated from public streaming data purely to score the game.

• Nothing in AUX is a security, investment, financial product, or real ownership, interest or right in any album, song, recording, composition, artist, royalty or revenue stream. Picking an album in AUX gives you no ownership of any music. You earn no real money from any music, and no real money is at stake.
• Prices, moves and replays of past weeks are game scores that may be delayed or wrong, and past moves say nothing about future ones. Nothing in AUX is financial, investment, tax or legal advice.
• AUX is not affiliated with, endorsed by or sponsored by any artist, record label, publisher or streaming service whose names, artwork or data appear in the game.

5. No gambling, no randomized items

• AUX has no packs, loot boxes or other randomized items. Album prices move only with streaming data, never with what players pick or swap.
• No gambling for real value. AUX does not offer gambling or wagering for money or anything of real-world value, and nothing you receive or win in AUX can be cashed out.

6. Leaderboards

Leaderboards and leagues are for fun and bragging rights. They do not award prizes of real-world value. We may remove results we believe were obtained by cheating or abuse.

7. Streaming data and music content

Game results depend on third-party streaming data, which can be delayed, incomplete or corrected after the fact. We may recalculate or correct prices, moves, scores and ranks when that happens. Album and song titles, artist names, cover art and song previews belong to their owners and are shown only to identify the music.

8. Your content and conduct

You keep ownership of the username and any league names you pick. You give us a worldwide, royalty-free license to host and display them within AUX (and in share images you choose to post) for as long as they are on your account. We may remove or change usernames and league names that break these Terms. You can report or block other players in the app.

You agree not to:

• Post content that is unlawful, hateful, harassing, sexually explicit, or infringes anyone's rights
• Impersonate another person or harass other players
• Use bots, scripts or multiple accounts, or exploit bugs, to gain rewards or ranking
• Buy, sell or trade accounts or game items
• Interfere with, reverse engineer, or try to gain unauthorized access to AUX

9. Deleting your account and termination

You can delete your account at any time in the app: Portfolio → your profile → Settings → Delete account. Deletion is permanent and erases your account and game data, as described in the Privacy Policy. We may suspend or terminate accounts that break these Terms, or if we discontinue AUX.

10. Changes to AUX and to these Terms

AUX is a game in active development. We may change, suspend or end any part of it at any time. We may update these Terms. For material changes we will notify you in the app or by email before they take effect, and continuing to use AUX afterwards means you accept them.

11. Disclaimers and limitation of liability

AUX IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF GAME ITEMS, SCORES OR DATA, AND OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO AUX WILL NOT EXCEED US $50.

Some jurisdictions do not allow these exclusions or limits, so some of them may not apply to you. You agree to indemnify us against claims arising from your breach of these Terms or your content.

12. Apple App Store

If you downloaded AUX from Apple's App Store: these Terms are between you and us, not Apple. Apple is not responsible for AUX or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to it (including product liability, legal or regulatory compliance, and intellectual-property claims). Your license to use AUX is limited to Apple-branded devices you own or control, as permitted by the App Store's Usage Rules. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules, except where the law of your country of residence requires otherwise. Before bringing any claim, you agree to contact us at support@playaux.com so we can try to resolve it informally within 30 days.
